Illinois Attorney General Lisa Madigan made the following statement regarding today’s decision by the U.S. Court of Appeals for the District of Columbia Circuit, in State of New York et al., v. Environmental Protection Agency, No. 03-1380, a case in which Illinois filed a Petition for Review of a Final Action of the U.S. Environmental Protection Agency (USEPA) challenging the US EPA’s efforts to allow power plants to evade Clean Air Act requirements when they conduct plant modifications. 

The DC Circuit held that the US EPA rules illegally violate the Clean Air Act and issued an order vacating the rules.

Today’s ruling from the DC Circuit recognizes what was clear to everyone but the Bush Administration: the proposed Equipment Replacement Rule was dead on arrival to the courthouse.  This massive attempt to gut the Clean Air Act would have caused irreparable injury to the air we breathe.  As I have said before, we will continue to go to court as long as it takes to protect our children, our communities and the environment from massive rollbacks of common sense precautions.
